REPORT ON THE DRAFT LAW REFORMING THE LABOUR AND SOCIAL SECURITY
* promote the Labour Inspectorate, create a new scale of sub-inspector specializing in health and safety, and adapting its organization to the transfer to the Autonomous Communities.
The Cabinet received a report of the Minister of Labour and Immigration Bill on the reform of the Law Officer of the Inspectorate of Labour and Social Security.
The Draft aims:
* strengthen the Labour Inspectorate making it a more specialized and more capable in the fight against fraud, with the best technological means to address the new challenges and new staff specialized in security and health,
* give it a more appropriate powers to the current scenario and to allow better cooperation between general and regional administrations. Objectives
To that end, the draft bill, which has been forwarded to the Economic and Social Commission for its opinion, has two basic contents:
1. Increases the potential of the inspection system, increasing the powers of staff to achieve greater capacity in the fight against fraud, especially in recruitment and employment of minors. Create a new scale of specialized Sub-inspectors safety and health that will enhance the actions of enforcement of regulations on the prevention of occupational hazards. At the same time regulating the use of new technologies and information systems, placing them in the service of inspection activity for efficiency in performance.
2. Establishes a legal framework that preserves the unity of the institution and make it compatible with the exercise of jurisdiction over the inspection function by the Central Government and autonomous regions, setting a new institutional support based on the following aspects:
* Strengthening multilateral cooperation through Sectorial Conference of Labour Inspection and Social Security and bilateral cooperation between the Central Government and Regional Administration in each territory.
* Create a specific organ involvement of the Autonomous Communities in the direction of the system, called the General Authority, which will integrate the autonomous communities in the process of making decisions on key issues of the system as a whole. Legal status
also defines the legal regime of inspection personnel with a common (national inspection bodies, ingreso y selección únicos, y movilidad entre Administraciones) y garantiza, de modo esencial, el principio de unidad de función y actuación, que permite a los Inspectores y Subinspectores adoptar medidas en todas las materias socio-laborales, ya sean de competencia estatal o autonómica, con independencia de la adscripción del funcionario a una u otra Administración.
